1. Agreement
These Terms of Service govern your use of the Hired AI application and related services (the “Service”), operated by outGo LLC (“Hired AI,” “we,” “our,” or “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Section 3 is the most important part of this agreement. It describes the authority you give us to act on your behalf, and the responsibility you keep.
The Service is currently offered in the United States only.
2. What the Service does
Hired AI helps you find and apply to jobs. Specifically, it:
- Collects open roles from employer job boards and matches them to your profile
- Presents matched jobs for you to accept or decline
- Tailors your résumé to a specific job posting, when you choose to
- Completes and submits job applications on your behalf
- Provides you an application email address and forwards mail sent to it
- Tracks the status of applications you have submitted and notifies you of updates
The Service requires an account and a subscription. A free trial may be offered, as described in Section 6.
3. Your authorization, and your responsibility
3.1 What you authorize us to do
When you swipe right on a job, you instruct and authorize us to submit an application in your name through the employer’s applicant-tracking system. This authorization covers every applicant-tracking system the Service supports, currently Greenhouse and Paylocity, and any we add.
You authorize us to:
- Fill out that employer’s application form using your profile, résumé, and saved answers
- Submit your résumé as uploaded, or a tailored version of it when you choose tailoring
- Answer application questions using information you have provided, including your work authorization and sponsorship status as stated in your profile
- Acknowledge standard notices on your behalf, such as an employer’s privacy notice, and confirm that the information submitted is accurate to the best of your knowledge
- Use your Hired AI application email address on the application
- Receive email at that address, including verification codes required to complete a submission, and complete those verification steps on your behalf
- Provide the standing consents you have given us, if any
3.2 What we will not do
We will not:
- State any fact about you that you have not provided to us
- Agree on your behalf to arbitration agreements, non-disclosure or non-compete terms, export-control (ITAR) attestations, codes of conduct, or similar legal terms. These are always shown to you, and the application pauses until you answer.
- Answer questions about criminal history or professional license status unless you have answered them yourself
- Complete Equal Employment Opportunity or other voluntary demographic questions. These are declined by default.
- Collect or provide your Social Security number. Applications that require one are not submitted.
- Circumvent security controls that employers or their application systems have deliberately enabled.
When an application asks something we cannot answer from your profile, such as your street address, date of birth, availability, or prior employment with the company, we pause it and ask you once. Your answer is saved and may be reused on future applications that ask the same question.
3.3 Your responsibility
Applications submitted through the Service are your applications. Your name is on them, and you are responsible for their contents. You agree that:
- The information you give us is accurate, current, and truly yours
- You will keep it up to date
- You will review the answers and standing consents you have configured, and understand that they will be used on your behalf
- You are solely responsible for any misrepresentation in an application submitted for you
We cannot recall a submitted application. Once an employer has received it, it is out of our hands. Review your profile before you swipe.
3.4 Submission is not guaranteed
We do not guarantee that any given application will be submitted, received, or delivered successfully. Applications may fail because an employer’s form changes, a posting closes, a system is unavailable, a required question has no answer in your profile, or a verification step cannot be completed. We will tell you when an application does not go through.
4. Your application email address
We provide you an email address at larchmail.com for use on applications. You understand and agree that:
- This address appears on applications we submit and is how employers will reach you
- Mail sent to it is received, processed, stored, and forwarded to your real email address, except verification codes, which we use to complete your applications and store but do not forward
- The address stays active while your account exists, including after you cancel a subscription, so that employer replies to past applications are not lost
- When you delete your account, the address is closed and its mail is deleted. Employers who reply to past applications after that will not reach you through it.
- You will not use it for anything other than job applications through the Service
5. Accounts
You must be at least 16 years old. You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.
6. Subscriptions and billing
Subscription required. Applying to jobs through the Service requires an active subscription or free trial. One application during onboarding is free and uses no credits.
Credits. Applications use weekly credits. Your plan includes a weekly credit allowance, shown in the app before you subscribe. An application uses credits when you submit it: a standard application uses fewer credits than one with a tailored résumé, and the cost is shown in the app before you apply. If an application does not go out, its credits are returned automatically. An application that pauses to ask you a question has not failed.
Credit rules. Credits reset weekly on the schedule shown in the app. Unused credits do not roll over, have no cash value, cannot be transferred or exchanged, and end when your account is deleted. A plan’s credits let you apply up to the number of applications shown in the app; tailored applications use more credits, so you can send fewer of them.
Free trials. If a free trial is offered, its length, the credit allowance during the trial, and the price after the trial are shown before you start. Unless you cancel at least 24 hours before the trial ends, your subscription begins and your Apple account is charged.
Billing. Subscriptions are billed through Apple and renew automatically at the end of each period unless cancelled at least 24 hours beforehand. Your Apple account is charged at confirmation of purchase and at each renewal. Current prices and billing periods are shown in the app before you purchase.
Cancellation. Cancel any time in your Apple account settings. Cancellation takes effect at the end of the current period, and you keep access until then. After that you can no longer submit new applications, but your account, application history, and application inbox remain until you delete your account.
Refunds. Purchases are handled by Apple and are subject to Apple’s refund policies. We cannot issue refunds directly.
Price changes. We may change prices. Changes do not affect your current period, and we will give notice before any change affects you.
Allowances. Credit allowances and credit costs may be adjusted. If we change them in a way that materially reduces what your plan includes, we will notify you first, and the change will not apply to a period you have already paid for.
7. Acceptable use
You agree not to:
- Provide false, misleading, or fabricated information about your identity, work history, education, credentials, or eligibility to work
- Use the Service to apply on behalf of another person, or to submit applications for anyone other than yourself
- Use the Service for any unlawful purpose
- Attempt to bypass usage limits, or operate multiple accounts to do so
- Reverse engineer, decompile, or extract the source code of the Service
- Interfere with the Service or attempt unauthorized access to it
- Resell or redistribute the Service
Submitting applications containing false information may constitute fraud and may expose you to legal consequences from employers. We may suspend or terminate accounts we reasonably believe are being used this way.
8. Third-party systems
The Service interacts with employer job boards and application systems operated by third parties. Those systems have their own terms and privacy policies. We do not control them, we are not responsible for them, and their availability or behavior may change without notice — which may affect our ability to submit applications.
9. Content and ownership
Your content. You keep all rights to your résumé and the information you provide. You grant us a non-exclusive, worldwide licence to store, process, modify, and transmit it solely to operate the Service for you — including creating tailored résumé versions and submitting them to employers. This licence ends when you delete the content or your account, except where we must retain it as described in Section 9 of the Privacy Policy.
Tailored résumés. Résumé versions generated for you are yours.
Our content. The Service itself, including its software, design, and branding, belongs to us. You may not copy, modify, or create derivative works from it.
10. No guarantee of outcomes
We do not guarantee that you will receive interviews, offers, or employment. We do not guarantee that any application will be read, that any employer will respond, or that tailoring will improve your results.
Résumé tailoring and application answers are produced by automated systems. They may contain errors. You are responsible for reviewing what represents you.
11. Service provided “as is”
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, lost employment opportunities, or lost data.
Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100.
This limit applies regardless of the legal theory and even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or information you provided that was false or misleading.
14. Termination
By you. Delete your account at any time in the app. Deleting your account deletes your profile, résumés, saved answers, application history, and your application inbox. Cancel your subscription separately through Apple; deleting your account does not cancel an Apple subscription.
By us. We may suspend or terminate your access if you breach these Terms, if we reasonably suspect fraudulent use, or if required by law. We may discontinue the Service with reasonable notice.
What survives. Sections 9 (ownership), 10 (no guarantee), 12 (liability), 13 (indemnification), and 16 (disputes) survive termination.
15. Changes to these Terms
We may update these Terms. We will post the updated version and change the “Last updated” date. For material changes — particularly to Section 3 — we will notify you in the app before they take effect. Continuing to use the Service after that constitutes acceptance.
16. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
Before filing any formal claim, you agree to contact us at support@tryhiredai.com and attempt to resolve the matter informally for at least 30 days.
17. General
Severability. If any provision is unenforceable, the rest remains in effect.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between us regarding the Service.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Apple. These Terms are between you and us, not Apple. Apple is not responsible for the Service or its content, has no obligation to provide support for it, and is a third-party beneficiary of these Terms with the right to enforce them against you.
